
CONDITIONS OF HIRE - VERY IMPORTANT - PLEASE READ
THESE CONDITIONS MUST BE MET BEFORE ANY EQUIPMENT CAN BE RELEASED
1. DEFINITIONS AND LAW
1.1 Any reference to Disco-Box throughout these conditions shall also refer to any persons or part thereof. 1.2 "the Equipment" shall mean sound, lighting and other item or services hired by Disco-Box. 1.3 "the Customer" is the person, firm, company or public body hiring the Equipment and this expression includes their successors or personal representatives. Any persons purporting to act on behalf of the Customer shall also be bound by this Contract of Agreement. 1.4 "Hire Charge" shall be the rate of hire i.e. cost, for the Equipment as specified on the Hire Agreement. 1.5 This Hire Agreement shall be interpreted and applied in accordance with English Law, and the parties to this contract agree to submit to the exclusive jurisdiction of the English Courts.
2. CHARGES
2.1 Hire Charges must be paid in full upon collection of, or to reserve the Equipment. 2.2 Equipment will not be reserved without payment of the Hire Charge. 2.3 Disco-Box reserve the right to charge up-to the full Hire Charge for any Equipment cancelled later than 14 working days prior to the date booked. 2.4 In the event of the Customer not cancelling or not collecting any booked Equipment no refunds will be made and cannot be re-scheduled. 2.5 All Charges are payable on demand.
3. COMMENCEMENT OF HIRE
3.1 The Hire Period commences at 1:30pm on the date agreed when booking. 3.2 If the Customer collects the Equipment earlier, then the Hire Period is 24hours from the point of collection.
4. DEPOSIT AND IDENTIFICATION
4.1 A minimum deposit of £30.00 will be required. 4.2 Customers hiring large amounts of Equipment, or any Equipment with a high purchase value will be required to leave a larger deposit, as deemed suitable by Disco-Box. 4.3 Deposits can be left by Credit or Debit Card, PayPal or Cash – Cheques are not accepted. 4.4 Customers need to leave the Deposit by Credit/Debit Card will be subject to the additional conditions as detailed in section 5 below. 4.5 The Deposit shall be returned to the Customer only upon termination of the Hire, as defined under clause 6.6 below. 4.6 The Customer will be required to l
Produce, as proof of their identity, a valid Driving License or Passport which will be copied. The copy will be destroyed on return of goods. 4.7 Sight of a second form of Customer identification will be required as proof of current address. This identification must take the form of a current official document or recent Utilities Bill e.g. Gas, Electric, Telephone, Bank statement etc.
5. DEPOSIT BY CREDIT/DEBIT CARD
5.1 Credit/ Debit Card Deposits can only be made by the person leaving the identification, as stated clauses 4.3 and 4.4 above. 5.2 Customers must leave Deposits by Credit/Debit Card must also pay for the Hire by the same method. This allows us to check the authenticity of the Card. 5.3 By signing the Hire Agreement the Customer thereby authorises Disco-Box to deduct any sums properly due to Disco-Box arising under a breach of these conditions from the Credit/Debit Card details held by Disco-Box. 5.4 In the event of Equipment being damaged, as detailed in clause 6.5, the Deposit will be taken by Disco-Box immediately, with any balance being returned to the customer after the repair costs are established. These costs will be as stated within clauses 8.1 and 8.2 below.
6. EQUIPMENT RETURN
6.1 The Equipment is due for return before 12.00 noon on the last date specified in the Hire Agreement. 6.2 Equipment must be returned in a clean, serviceable and working order. Failure to return Equipment in this manner will be subject to additional charges as stated in clause 6.4. 6.3 For late returns additional charges will accrue at the full daily hire rate for any equipment, or part thereof not returned by the time specified in clause 6.1 6.4 The Customer will reimburse all costs incurred by Disco-Box in rectifying the condition of any Equipment returned damaged or unclean. These costs will be as detailed in clauses 8.1 and 8.2 below. 6.6 Only on satisfactory fulfillment of the above clauses will the Hire be deemed complete by Disco-Box.
7. CUSTOMER'S RESPONSIBILITIES
7.1 The Customer's responsibility for the Equipment commences on receipt of the Equipment by the Customer and ends when the Hire has finished, as defined in Clause 6.5. 7.2 The Customer shall not at any time sell, dispose or otherwise part with control of the Equipment or attempt to do so. 7.3 The Signatory to the Hire Agreement and the Customer jointly and severally undertake with Disco-Box that everyone who operates the Equipment has been properly instructed in its safe and proper use and will ensure that the Equipment will not be misused. 7.4 The Customer shall under no circumstances attempt to or arrange for the Equipment to be repaired without written authorization from Disco-Box. 7.5 It should be noted by the Customer that any breach of clauses 7.3 and 7.4 above may jeopardize your cover under our Public Liability Insurance. 7.6 Nothing in these clauses and conditions shall affect the statutory rights of the Customer.
8. INSURANCE
8.1 Hire equipment is NOT insured by Disco-Box once it has left the building. 8.2 The Hirer agrees to pay Disco-Box the full replacement value of any Equipment lost, stolen or damaged beyond economical repair (without any deductions for usage wear, tear or age). 8.3 In the case of any Equipment which is lost, stolen or damaged beyond economical repair the Customer shall also pay a charge at the full daily rate until the Equipment is replaced. 8.4 It is strongly advised that the Customer makes provisions under their present Insurance policy/ies or take out adequate Insurance to ensure the costs and charges expressed in clauses 8.1 and 8.2 above are covered. 8.5 The Customer shall not compromise or settle any claim without appropriate authorization from Disco-Box.
9. ELECTRICAL EQUIPMENT
9.1 Any Electrical Equipment should be used with the plugs and/or sockets supplied and fitted. 9.2 The Customer shall be responsible at all times to arrange a proper supply of electricity for use with the Equipment and to ensure that the Equipment is properly earthed at all times. 9.3 All Electrical equipment for hire will have been checked/tested and carry a valid P.A.T label. Cables must be returned COILED & TAPED with tie wraps where provided. A Charge could be applied for cables not returned this way.
10. COMPATIBILITY
10.1 It is the sole responsibility of the Customer to ensure that the Equipment hired is compatible and may be safely used with any other Equipment being used by the Customer. 10.2 The Customer shall be responsible for ensuring that any Equipment is suitable for their purposes.
11. CUSTOMER LOSSES
11.1 Nothing in these Conditions shall make Disco-Box liable for any loss to the Customer including any expense, liability, loss, claim or proceedings whatsoever caused by or arising, under any circumstances, from the hire of the Equipment.
12. POWER TO ENTER THIS CONTRACT
12.1 The Signatory on the Hire Agreement warrants that they are duly authorized on the Customer's behalf to enter into this agreement and hereby personally indemnifies Disco-Box against all losses and costs that may be incurred should this not be the case.
13. RIGHTS RESERVED
13.1 Any failure by Disco-Box to enforce any or all of these Conditions shall not be construed as a waiver of any of Disco-Box’s rights hereunder. 13.2 If any clause in this contract shall be deemed to be held invalid such invalidation shall not affect the validity of the remaining clauses.
14. ACCEPTANCE
14.1 Undertaking to hiring the Equipment and/or sighing the Hire Agreement constitutes the Customer's full acceptance of the Conditions.
Prices quoted are for a 24 hours block (1:00pm - 12:00 Midday the following day) Weekend and longer term charges can be arranged - Please phone for a full quotation. Disco-Box reserve the right to alter these standard charges for any specific date or period.
